By accessing this site or placing an order, you agree to be bound by these terms. If you do not agree, please refrain from using this website.

This website is owned and operated by an independent artist based in the Netherlands, registered with the Dutch Chamber of Commerce (Kamer van Koophandel) under KvK number: 58136274.

2. Artworks and Representation

  • Every original painting offered on this website is a unique, one-of-a-kind physical artwork.
  • I strive to display the colors, textures, and details of my paintings as accurately as possible. However, because digital screens, devices, and lighting conditions vary, the physical painting may differ slightly in tone or appearance from how it looks on your monitor.
  • All artworks are subject to availability.

3. Prices, Taxes, and Customs

  • All prices listed on the website are final and include Dutch VAT (BTW). Your final invoice will clearly break down the VAT amount for your administration.
  • For international orders shipped outside the European Union (EU), the buyer is solely responsible for any local import duties, customs fees, or clearance taxes that may be levied by the destination country. I have no control over these charges and cannot predict their amount.

4. Order Process and Contract Formation

  • When you place an order and submit payment through Mollie or WooPayments, you are making an offer to purchase the artwork.
  • You will receive an automated email acknowledging your order details. However, a legally binding sales contract is only officially formed when payment is cleared and I dispatch the artwork (indicated by sending you a shipping confirmation email with tracking details).
  • I reserve the right to cancel an order and issue a full refund at my sole discretion prior to shipping due to unforeseen circumstances—such as an item being unavailable (e.g., sold simultaneously at an in-person exhibition), payment processing issues, or an obvious technical pricing error.

5. Intellectual Property and Copyright (Pictoright Protection)

  • Retention of Rights: When you purchase a physical painting from me, you are buying ownership of the physical object (the canvas/linen and paint layers). I retain full and exclusive copyright to the underlying artwork, imagery, and composition.
  • Restrictions: The purchase does not grant the buyer any reproduction rights. You may not print copies, create digital reproductions, sell merchandise, or utilize the artwork for any commercial purposes without my express, prior written consent.
  • Pictoright Membership: I am a registered member of Pictoright (the Dutch collective management society for visual arts). Pictoright actively monitors, manages, and enforces my visual copyright globally. Any unauthorized commercial reproduction, modification, or distribution of the images, text, or artwork found on this website will be subject to enforcement.

6. Shipping, Delays, and Risk

  • I process orders within 2 business days. To ensure peace of mind, all paintings are shipped via insured, tracked postal or courier services (primarily PostNL or alternative flexible carriers).
  • While I provide estimated delivery timelines, these are indicators and not strict deadlines. I am not liable for shipping delays caused by customs processing, postal strikes, or force majeure events beyond my reasonable control.

7. Returns and Liability Limitation

  • Due to the unique, delicate, and high-value nature of original fine art, all sales of original paintings are considered final, and standard returns are not accepted. (For specific details regarding transit damage or missing shipments, please consult the Refund and Returns Policy page).
  • I am not liable for any indirect, incidental, or consequential damages arising from your use of this website, temporary website downtime, or technical interruptions.

8. Governing Law These Terms and Conditions are governed exclusively by and construed in accordance with the laws of the Netherlands. Any disputes arising out of or in connection with these terms shall be submitted to the exclusive jurisdiction of the competent courts in the Netherlands.
